Terms of Use

1. Agreement to terms

These Terms of Use ("Terms") set the rules for accessing and using https://pronlabs.com and related services (together, the "Service") provided by PronLabs ("we", "us", "our").

These Terms incorporate our Privacy Policy. By using the Service, you agree to these Terms and our Privacy Policy.

By visiting or using the Service, you agree that these Terms apply to you. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your place of residence if higher, to use the Service.

The Service may involve adult or sensitive content. You are responsible for ensuring that using the Service is legal in your jurisdiction.

You may upload only synthetic content that does not depict or imitate an identifiable real person, or a photo of yourself where the feature permits it. You must not upload, reference or use another real person's image, likeness or voice, even with their permission.

3. Accounts and security

Some features require an account. The information you provide must be accurate.

You are responsible for:

• Maintaining the confidentiality of your login details
• All activity that occurs under your account

You must notify us promptly if you believe your account has been compromised.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or are using the Service in a harmful way.

4. Content, prompts and uploads

4.1 Your responsibilities

You are solely responsible for the text, images, videos and other content ("User Content") you submit, upload or generate through the Service.

You must ensure that you have all necessary rights to use any permitted material you submit. Permission from another real person does not make their image, likeness or voice permitted on PronLabs.

4.2 Content standards and enforcement

The following content and conduct are strictly forbidden, whether or not our safety systems detect them:

• sexual, exploitative or abusive content involving anyone under 18, who appears under 18 or whose age is ambiguous
• content depicting or imitating another real person, including a celebrity, public figure or private person
• non-consensual sexual content, including intimate imagery, sexual deepfakes, digital forgeries or sexualised impersonation
• graphic violence, serious injury or extreme gore
• content that facilitates or promotes illegal activity
• content that violates privacy, publicity or intellectual property rights, or payment-network rules
• attempts to evade or bypass safety controls, filters or restrictions

We use safety systems to detect and block prohibited requests and outputs, but a failure to block content does not make it allowed. We may block generations, remove or restrict content, restrict features, suspend or terminate accounts, and preserve or disclose information to enforce these Terms, protect people or comply with law.

5. Generated content

The Service uses generative AI models to create images and videos from your inputs. Because of how AI generation works, outputs can be imperfect, unexpected, or resemble outputs generated for others.

Subject to these Terms and applicable law:

• You may use, copy and share content you generate through the Service for lawful purposes, including personal and commercial use where permitted by law and third-party rights. We do not grant rights held by others or guarantee that any output is suitable for commercial use.
• We do not promise that generated content will be free of third-party rights (for example, if you use prompts referencing brands or copyrighted works).

You are responsible for ensuring that your use of generated content complies with all applicable laws and with any third-party rights.

6. Prohibited uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable law
• Harass, threaten, defame, or otherwise harm others
• Interfere with or disrupt the Service or its security
• Access or use the Service by automated means (bots, scripts, etc.) in a way that overloads or abuses the system
• Attempt to bypass usage limits, access controls or technical restrictions
• Reverse engineer or attempt to extract our models or source code, except as permitted by law
• Use the Service to provide competing AI generation services without our written permission

We may monitor use of the Service as reasonably necessary to operate it, enforce these Terms and protect our users.

7. Payments and credits

Some features currently require payment through one-time credit packs.

• Changes. Prices, plans, credit packages, and availability may change from time to time.
• Final sale. Unless otherwise stated, purchases are final and non-refundable except where required by law. If we choose to issue a refund or credit adjustment, we may do so in our discretion.
• Third-party fees. Your payment provider may charge additional fees (for example, processing fees or currency conversion).
• Payment processing and authorization. Payments are handled by third-party processors. By making a purchase, you authorize us and/or our processors to charge your selected payment method for the amount shown at checkout (and applicable taxes, if any).
• Non-delivery / technical issues. If a technical issue prevents delivery of purchased credits or access, contact us and we’ll investigate and, where appropriate, restore access or credit your account.
• Disputes and chargebacks. If you initiate a payment dispute or chargeback, we may suspend access and disable purchases while we investigate and to reduce fraud and processor risk.
• One-time purchases. Credit packs do not automatically renew and include Pro access for the period shown at checkout.

8. Copyright and safety reports

We respect intellectual property rights. If you believe content on the Service infringes your rights, email us at hi@pronlabs.com with: (i) your name and contact details, (ii) identification of the work claimed to be infringed, (iii) identification of the allegedly infringing material and where it appears on the Service, and (iv) a statement that you have a good-faith belief the use is not authorized. We may remove content and, in appropriate circumstances, restrict repeat offenders.

Anyone may report suspected non-consensual intimate imagery, a sexual deepfake, impersonation or misuse of a person's image or likeness. You do not need a PronLabs account. The person depicted, or their authorised representative, may request removal by emailing hi@pronlabs.com with the subject "Safety report" and include:

• a physical or electronic signature of the depicted person or their authorised representative
• the URL, generation ID or other information reasonably sufficient to locate the image or video
• a brief statement that you believe in good faith the depiction is not consensual, including relevant information that may help us determine it was published without the depicted person's consent
• contact information for the depicted person or their authorised representative

Where required by applicable law, we will remove content covered by a valid request as soon as possible and no later than 48 hours after receipt, and make reasonable efforts within the same period to identify and remove known identical copies.

9. Intellectual property

We and our licensors own all rights, title and interest in and to the Service, including but not limited to software, models, design, trademarks, logos and overall look and feel, excluding your User Content and generated outputs.

These Terms do not grant you any ownership rights in the Service. You may not copy, modify, distribute, sell or lease any part of the Service, nor reverse engineer or attempt to extract any source code, except as permitted by law.

10. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind.

To the maximum extent permitted by law, we do not make any guarantees or warranties about the Service, including that it will be uninterrupted, error-free, secure, accurate, or suitable for any particular purpose.

You use the Service at your own risk. You are responsible for your prompts, uploads and the way you use any generated content.

11. Limitation of liability

To the maximum extent permitted by law:

• We will not be liable for any indirect, incidental, consequential, special or punitive damages, or for loss of profits, data, business or reputation, arising out of or in connection with your use of the Service.
• Our total aggregate liability for any claims relating to the Service or these Terms will not exceed the greater of (i) the amount you paid us for use of the Service in the 3 months before the claim arose, or (ii) USD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnity

You agree to indemnify and hold us harmless from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your User Content or generated content
• Your violation of these Terms or of any law or third-party right

13. Termination

You may stop using the Service at any time and may request deletion of your account.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe:

• You have violated these Terms
• Your use creates risk or possible legal exposure for us or other users
• We decide to discontinue the Service

If your account is terminated, certain provisions of these Terms that by their nature should continue to apply (for example, sections about intellectual property, limitation of liability and indemnity) will survive.

14. Governing law and disputes

Any disputes arising out of or relating to these Terms or the Service will be subject to the non-exclusive jurisdiction of the courts of Hong Kong.

15. Changes to these Terms

We may update these Terms occasionally. When we do, we will update the "Last updated" date at the top.

If we make material changes, we will take reasonable steps to notify you (for example, by posting a notice on the Service). Your continued use of the Service after any changes become effective means you accept the updated Terms.
